Notable Litigation Actions

The SCVCA’s confirmation of the trial judge’s orders in  NAB v Rose [2016] VSCA 169 may have “far-reaching consequences for consumer banking“.

The ACCC has amended its statement of claim against ANZ and Westpac in its BBSW unconscionability litigation; it is now consistent with the claim against NAB.

Well, their litigation certainly goes on and on… The Full Federal Court has dismissed NRM’s appeal, confirming the Federal Court’s findings that it acted unconscionably when “frightening men” to sell them treatments for erectile dysfunction.  NRM’s contempt penalty hearing is still pending.
